GENERAL TERMS AND CONDITIONS (GTC)
1. Scope
These General Terms and Conditions (GTC) apply to all contracts between Holzwerk Studio , owner Andre Netesov, Copypark / Holzwerk.Studio, and its customers via the online shop as well as via individual orders.
These terms and conditions apply to both consumers (B2C) and businesses (B2B) . For the purposes of these terms and conditions, a business is any natural or legal person acting in the course of their commercial or independent professional activity when concluding a contract.
Any differing terms and conditions of the customer will not be recognized unless Holzwerk Studio expressly agrees to their validity in writing.
2. Conclusion of the contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By submitting the order, the customer makes a binding offer to conclude a purchase agreement. The contract only comes into effect when Holzwerk Studio expressly confirms the order or ships the goods.
3. Products & Custom-made items
Holzwerk Studio offers both standard products and custom-made products .
Custom-made items are manufactured according to customer specifications. Variations in color, grain, and surface texture are inherent to the material (wood) and do not constitute a defect.
Custom-made products are excluded from the right of withdrawal if they have been specially manufactured according to customer specifications (§ 312g para. 2 no. 1 BGB).
4. Prices & Payment
All prices are in Euros.
Unless otherwise stated, prices do not include shipping, customs or import charges .
For deliveries to EU countries and Switzerland, additional taxes, customs duties or import fees may apply, which are to be borne by the customer.
The available payment methods are displayed at checkout.
5. Shipping & Collection
Shipping is available within the EU and to Switzerland.
Delivery times are non-binding estimates . Delays caused by shipping providers, customs, or force majeure are beyond our control.
Alternatively, local pickup is possible – if offered.
The risk passes to the customer upon handover of the goods to the shipping service provider (in the case of consumers, only upon receipt of the goods).
6. Right of withdrawal
Consumers generally have a statutory right of withdrawal.
The right of withdrawal does not apply in the following cases:

individually manufactured products

Goods that are clearly tailored to personal needs
Details are governed by the separate cancellation policy .
7. Warranty
The statutory warranty rights apply.
In B2B transactions, the warranty period is limited to 12 months , provided this is legally permissible.
Natural material properties of wood (grain, color variations) do not constitute a defect.
8. Liability
Holzwerk Studio accepts unlimited liability in cases of intent and gross negligence.
In cases of slight negligence, Holzwerk Studio is only liable for breaches of essential contractual obligations and only to the extent of foreseeable damage.
Liability for indirect damages, lost profits or data loss is excluded to the extent permitted by law.
9. Retention of title
The goods remain the property of Holzwerk Studio until full payment is received.
10. Intellectual Property
All content, images, designs and texts are subject to copyright.
Use without express written permission is prohibited.
11. Applicable Law & Jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For merchants, the place of jurisdiction is the registered office of Holzwerk Studio.
12. Severability Clause
Should any provision of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
